ATTN: PROSECUTOR Case # L***************
SHERIFF DOUGLAS C. GILLESPIE
POLICE CHIEF CHRISTIAN MONTANO
PEACE OFFICER JACKSON #13418
PEACE OFFICER WRIGHT #13587
All Parties involved
To all parties involved,
My name is Benjamin Franklin. I have been a victim of your police department/city. I am writing to briefly inform you that I will be requesting motion for dismissal. I am also writing to request peace officer Jackson #13418, peace officer Wright #13587, the two supervisors requested to the scene, and any other officer(s) on the scene bonding cards. Lastly I am requesting that all my property be rightfully returned to me which include a Maryland Driver’s license and miscellaneous cash that was stolen in the denominations of five(s) ($5’s) and one(s) ($1’s) USD presumably by parties involved.
To inform all parties I will be using the Trezevant V. City of Tampa (1984) 741 F.2d 336, hn. 1 case if I must. I will also be entering time stamped photographs onto the record for the brutality and damages that were caused to my persons. Not only do I have documented chronic back problems which I had continued to inform the officers of, but I was also denied access to my medication on multiple occasions from many parties including parties within the Clark County Detention Center.
In direct correlation with the above I was brutally thrown onto the hood of officer Jackson #13418 and officer Wright’s #13587 squad car in record heat (near 120 degrees this day). Moreover the car had been idling for nearly ten minutes and more than likely driving all day in this heat. I have photographic documentation that I will be placing on record as stated above with the burns I suffered on my arms and wrists from this brutality. Officer Jackson #13418 and officer Wright #13587 legal logic for this was that because I was requesting a supervisor before providing identification that they have legal authority to detain and brutalize me. I was never once informed of my exact charges or exactly why I was being detained until after being detained and within a few hours of my release.
If I must I intend to file a tort claim against the necessary parties for these criminal harmful actions against me. I will once again request a dismissal.
I am putting all parties on notice that I expect a reply to this letter within thirty (30) business days, as after thirty days any un-rebutted request is entered as fact into the record. I am looking forward to your replies. You can reply by writing to.
