Should I be on the lookout for mortgage fraud?
my fiances parents refinanced their home in January 2009 with LENDAMERICA with MERS acting as nominee. On February 11 2009 LENDAMERICA used MERS to convey and assign the mortgage or interest over to GATEWAY BANK FSB. Gateway is now currently looking to pursue a foreclosure action against them for defaulting on two payments. Gateway bank FSB has sent gateway bank FSB servicer to collect on the defaulted payments. The letter they received states that this is an attempt to collect a debt. This is not a demand for payment. I've been studying the assignment of record and noticed that the assistant Vice President who signed off on the document is named Kim A Hagen, and upon research found out that she is an employee for a company called CENLAR. The notary who signed the document is also an employee for the same company as her. The assignment has a date recorded of 8/11/15. In the small computerized print on the assignment it reads that MERS, acting as nominee for LENDAMERICA assigns and conveys the mortgage to gateway on 2/11/2009. So I was on the foreclosure relief page here on sovereign connection and came across a subject on how to do a Fannie Mae loan lookup. I did and it says at the top of the screen that famine mae owns the loan. At the bottom of the screen it says that LENDAMERICA assigned it to gateway. I'm so confused as to what this means. Does it mean anything? The notice that my fiances parents received in the mail states that gateway owns the promissory note. I really need some feedback and intelligence on this, and some intelligence as to what to do next if this is something to look further into. I have not determined if whether or not the loan has been securitized. i have spotted fraud in the assignments pertaining to their original mortgage, robo signing and notary fraud, along with fraudulent dates. So I feel like we have a basis for concern to make sure that do not get robbed again. Also I'm curious as to whether or not we could bring an action to sue the banks involved in the original mortgage for theft, even though that mortgage has been paid in full by my fiances parents and has since been satisfied. Is it to late to do anything?
