When my husband went to prison the court somehow had him sign documentswherebyhe became "bound" as a new debtor (9-508). Ifthis is the case I further assume the courts have somehow filed a financing statment and attached it to his entire estate. Once he files the UCC-1 he can request fromthe Secretary of States office a full accounting of his record? My understanding of Article 9 implies that ifthe court did this it was without full consent/knowledge on his part which makes recovery possible through a tort claim? However9-204(b) (2) states that furture Tort Claims must be specifiedin Authenticated Security Agreement?
