Can I spend the evidence of debt right now?

Ok...since the fiduciary has not returned the bond and the thirty day time frame has long expired with no evidenced attempt to obey the bond order regarding the check for normal operation of the TRUSTs day to day affairs, can we begin issuing Trust capital units backed by the perceived accounts receivable?
