I have a workers comp case in which I am the injured party and my employers insurance has a claim on the first $100k of a civil claim. The policy of the defendant is $15k. So, the employer law says they have a lein on that $15k. Based on UCC 1 security party filing, my security agreement and UCC 9-304 shouldn't my legal fiction be in first position on that $15k?
