I have a question regarding wrongful imprisonment…
Hi,
I have a friend who was put in prison 3 years ago. The reason why he was put in prison was because of possession of an unlicensed handgun.
One day the police entered his home, to my knowledge, without a warrant. They entered his home on suspicion that he may be in possession of canabis. My friend walked away from that life years ago prior to the police storming into his home. The reason why they were suspicious of his possible possession is because a "so-called" old friend of my friend was arrested, and cut a deal with the police if he would give up a name. He gave up my friend.
When the police stormed his apartment, they found my friend with his wife and newborn son. They trashed the place, confiscated their money and eventually found an unregistered gun. My friend told the police it was his because the cops threatened to take them both in if nobody claimed the gun, leaving the child without a guardian (Its irrelevant but it was his wife's idea to get the gun). My friend has been in prison ever since.
My question in all of this is: Is there any redemption for him at all? Would the SPC process work for him? Would a Tort claim be relevant in this particular case? Or does he have to just suck it up, ride out his time and be a better judge of friends...? I'm just asking out of curiosity, but I was hoping I could at least get some useful information for future reference.
Thanks for reading...
