I purchased a vehicle through a finance company on Sept. 24, 2017 and when I signed my autograph on the 'contract', I signed it in purple and with the U.C.C. 3-402(b)/U.C.C. 2-207 NO PROTEST. I then sent Affidavit of Fact - Statement of Bill Protest on Car Loan & Affidavit of Fact - Writ in the Nature of Discovery & Full Disclosure notarized and by registered mail. The finance company never responded and so I went through all the steps, including Notice of Default & Opportunity to Cure & Contest Acceptance and the Certificate of Non Response - Notice of Default. The finance company never answered any of the affidavits neither did they comply with the request in regards to the car title and the 'discharge of debt'. This last Tuesday, after six months, the finance company sent and had my car repossessed. I called the sheriiff's department and they sent deputies but I couldn't find my file with the paperwork. I did finally find the paperwork for the Certificate of Non Response - Notice of Default. The deputies wouldn't do anything for me. What a surprise! I have since realized that the finance company must have had someone break into my home and steal the file with the paperwork. I keep it all in one place in my living room. My husband told me that when he came home from the store that he realized that our refridgerator was warm and that someone had turned it off. Fortunately, I have been able to recover most all of my documents and had my notary sign an affidavit that she had notarized all the documents and had mailed them, etc. I am getting ready to file a complaint at the Courthouse! Any suggestions on what I should do to recover my vehicle which of course the finance company has no legal right to! I just received in the mail a notice that says the finance company plans to sell my vehicle and it was addressed to me in upper and lower case letters.
